New rules for health facility projects

The law sets review thresholds at $11,500,000 for hospital projects, $6,500,000 for nursing home projects, and $3,000,000 for others. These amounts adjust each year for inflation. Planning costs, designs, studies, and donations or below–market transfers count toward capital spending. Applicants must show a 33% financial commitment to the total project cost, either spent or under signed contracts.

Assisted living and home dialysis exemptions

Dialysis sites that only train and support people for home dialysis are excluded from review. Dialysis units in licensed nursing homes that provide home dialysis to residents are also excluded. Capital projects at facilities licensed under the Assisted Living and Shared Housing Act, and conversions under Section 30 of the Older Adult Services Act, are excluded. The Board can still require quarterly statistics from the excluded dialysis sites and nursing homes.

Tighter rules for nursing home deals

When a nursing home changes ownership, the deal must follow Sections 3-101 through 3-119 of the Nursing Home Care Act. A demonstration project converting to a nursing facility must meet the licensing and certificate-of-need rules in effect on the day it applies. This adds compliance steps and current standards for transfers and conversions.
