Beginning January 1, 2023, sheriffs in Illinois third‑class counties charge set fees for serving court papers and related duties. You pay per event: $35 to serve or attempt to serve a summons, subpoena, warrant, or garnishee; $15 to return process; plus a $10 flat mileage fee for each service or attempt. The sheriff charges $9 per day to attend court with a prisoner. When the sheriff transports people to State institutions, the State pays per‑mile rates of $0.20 for the first person, $0.15 for the second, and $0.10 for each additional person. A sale of real estate by judgment costs $900; personal property sales cost $100 (up to $1,000), $300 ($1,001–$15,000), or $500 (over $15,000). The law also sets charges for levies, seizure orders, filing certificates, and preparing deeds; actual aid costs may be added when serving an order for possession of real estate. Recording fees must be advanced by the plaintiff or judgment creditor and are taxed as costs. These fees do not apply to police departments, other law enforcement agencies, units of local government, or school districts.
