Bill Overview

Analyzed Economic Effects

4 provisions identified: 2 benefits, 2 costs, 0 mixed.

More sentence credit for pretrial activities

People held before their current Illinois prison commitment can earn sentence credit for completing qualifying programs or county detention work. Programs include substance abuse treatment, education, behavior change, life skills, parenting, and re-entry planning, through counties or other providers. Substance abuse programs no longer need to be full-time or last at least 60 days. This credit is calculated at sentencing and included in the sentencing order. Other qualifying pretrial self-improvement, volunteer, or work activities can earn up to half a credit day per activity day. That separate credit includes qualifying days before July 1, 2021, and covers activities not eligible under the program-credit rule.

Prisoners gain sentence credit safeguards

Illinois corrections officials generally may take only 30 days of sentence credit without Prisoner Review Board approval for additional loss. This safeguard covers larger losses from one event and cumulative losses exceeding 30 days over 12 months. An exception applies to violations committed or discovered within 60 days of scheduled release. The Board cannot review a 30-day loss within a calendar year or impose more loss than the department requests. Corrections and juvenile justice directors can restore revoked, suspended, or reduced credits. Department rules must provide automatic restoration after a set period without disciplinary violations; the supplied text does not specify its length.

Monitoring required for protection-order offenders

Illinois corrections must require electronic monitoring when sentence credit releases someone early after a covered order-of-protection violation. The requirement applies to convictions under Criminal Code Sections 12-3.4 or 12-30. Monitoring is a condition of that early release.

Prisoners risk credits for frivolous filings

Prisoners can lose sentence credit when a court specifically finds a filing frivolous in a covered case. Covered cases include specified post-conviction, habeas corpus, civil rights, and claims proceedings against Illinois, corrections, the Review Board, or their staff. The corrections department must hold a hearing to seek credit loss before the Prisoner Review Board. The Board may take up to 180 days of credit, or all accumulated credit when fewer than 180 days remain.
