Insurers banned from charging provider fees

The law bans health insurers from charging providers or facilities any administrative fee or penalty tied to out-of-network care. Charging these fees is an unfair insurance practice and can be punished. This helps keep extra carrier fees from being pushed onto patients’ bills.

New rules for out-of-network billing fights

The law sets Indiana procedures for federal out-of-network billing disputes. The filer must notify the facility in writing within 3 business days and include the IDR form. Missing notice can trigger discipline; for providers, repeated violations are capped at $5,000 per year. If 25+ qualified disputes are filed in any 90 days, the insurer can require talks within 30 days and at least one conference, but no claim is decided there and meetings happen no more than once per quarter. Each conference creates a memo with the disputes, initial payment, the carrier’s offer, the provider’s ask, and the federal QPA; it is filed with the Insurance Department, and claim details stay confidential while only total memo counts are posted.
