Park wardens enforce litter laws statewide

Louisiana state park wardens can enforce litter laws throughout the state, not just within their usual jurisdiction. They can issue littering citations by mail or in person. Recovered civil penalties go into the litter abatement account within Louisiana's Conservation Fund.

Litter cases bring costs and hearing rights

Louisiana's Department of Culture, Recreation and Tourism can bring civil actions under the Administrative Procedure Act for litter violations under R.S. 30:2531(A) or (B). It can instead use an administrative hearing to enforce R.S. 30:2531. Hearings take place at the district office for the parish where the person lives or the violation occurred. People can skip the hearing by paying the fine; anyone assessed a civil penalty also owes attorney fees and costs. Written notice must give the hearing's time and place, either on a citation or summons or through certified mail. Certified-mail notice takes effect 15 days after the postmark. Either side can appeal to the district court where the offense occurred. After all appeal deadlines pass, the ruling is final for debt collection. The department's secretary must issue and enforce rules to carry out this process.
