Louisiana sets paperwork and payment rules for prisoners seeking to file civil cases, appeals, or writs without paying all fees upfront. Those in custody must provide certified trust-account records from each prison covering the past six months, or their shorter time incarcerated. Those no longer incarcerated must provide a sworn statement of current assets and supporting documents. Other requirements still apply, except Code of Civil Procedure Article 5183(A)(2). The first payment is 20% of the greater of average monthly deposits or average monthly balance over the preceding six months; the alternative is 20% of present assets under the legal fee schedule. Later monthly payments equal 20% of the previous month's income credited to the account, until filing fees are paid. The custody agency sends payments when the account exceeds $10; those outside custody send payments when money in their possession exceeds $10. Courts cannot allow a lawsuit to be formally served until the required paperwork and initial payment requirements are met. Prisoners denied permission to pay over time must pay full costs upfront or face dismissal without prejudice, which allows refiling but does not interrupt the legal filing deadline. Total fees collected cannot exceed the amount allowed by law.
