The law changes deadlines for wrongful death claims and survival claims seeking damages for harm suffered before death. Outside medical malpractice, both deadlines are the later of one year after death or two years after the injury or damage. Medical malpractice survival claims follow the separate deadline rules in R.S. 9:5628. Medical malpractice wrongful death claims have a deadline of one year after death.
