Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Addiction care workers get wage funding priority

Annual spending for Medicaid services from the addiction recovery trust is limited to investment earnings. First priority is wage increases for direct-care workers in Medicaid-certified addiction-provider settings. The health department and industry representatives must create a plan that passes the full wage increase through provider payment rates. Next come Medicaid services eligible for federal matching funds, followed by refunds of federal overpayments deposited in the fund. The law sets no individual raise amount.

Addiction fund spending faces limits and protections

After July 1, 2025, spending self-assessed fees, federal grants, or other fund sources requires a joint resolution. Approval requires two-thirds of the elected members of each legislative house. Authorized uses are provider-rate updates, a Medicaid addiction-provider payment system, and refunds of federal overpayments deposited in the fund. Provider rates must be updated under the approved Medicaid plan after the first intergovernmental transfer; later updates are limited to investment earnings. Trust money generally cannot replace state general-fund Medicaid funding below its fiscal year 2025–2026 level. The law allows an exception when official recurring revenue forecasts show the next year's budget can be funded at the same level.

New addiction care fund allows provider fees

Louisiana creates a permanent Medicaid Trust Fund for Addiction Recovery to help fund higher payments to licensed addiction-treatment providers. Covered care includes inpatient and residential treatment, intensive outpatient treatment, and withdrawal management. The fund accepts transfers and other money after required state bond payments; investment earnings and unused year-end money stay in the fund. The health department can charge providers fees that qualify for federal matching funds, capped at the state's service cost. These fees count toward insurance and other third-party reimbursement rates, and collections flow to the trust after required bond payments. The department must set fee collection, payment, and recordkeeping rules.
