New lawsuit deadlines for school debts

The law sets a 30-year deadline to sue over covered debts owed to Louisiana charities, schools, or funds left for charity or education. This also covers education debts owed to the state or its agencies, including student loans, stipends, and benefits. Federal Family Education Loan Program debts are excluded from that deadline. Other debts owed to Louisiana public colleges have a 10-year deadline, excluding student loans, stipends, and benefits. Both deadlines require written evidence of the debt, with “writing” defined by Louisiana Code of Evidence Article 1001. The law applies retroactively but does not revive debts already decided by a court by its effective date.
