Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 0 costs, 3 mixed.

Independent panel hears vehicle licensing disputes

Beginning August 1, 2025, the three public commission members exclusively decide covered disputes involving licensees and businesses operating without required licenses. Parties can get a hearing without first trying informal resolution; the panel can compel evidence and issue written final decisions, remedies, and fines. Aggrieved parties have 30 days after transmission or service of a decision to seek review in the Twenty-Fourth Judicial District Court. Panel members elect a hearing chair, avoid other commission business, and receive hearing pay instead of the usual commission per diem. Pay comes from commission administrative funds, cannot fall below the daily rate for Louisiana Supreme Court-appointed temporary judges or lawyers, and includes allowed expenses.

Louisiana sets new vehicle commission qualifications

Beginning August 1, 2025, Louisiana's Motor Vehicle Commission sits within the governor's office with 18 governor-appointed members, subject to Senate confirmation. Fifteen must be Louisiana residents of good character, have five consecutive years of active licensing before appointment, and stay licensed. These seats must include leasing or rental, heavy truck, marine product, motorcycle, recreational vehicle, and sales financing representatives. The other three must be retired judges or Louisiana lawyers with at least 10 years of legal experience who never held commission licenses. The governor appoints the chair from the state at large, and each of eight commission districts must have a member.

Some manufacturers can run warranty centers

Beginning August 1, 2025, some manufacturers and distributors can operate one or more licensed satellite warranty and repair centers. They must have held a commission license to lease vehicles, directly or through a subsidiary, on January 1, 2024. Neither they nor any common entity can have, or ever have had, franchised dealers licensed in Louisiana. Common entities include businesses under direct or indirect ownership or control, including more-than-30% equity links or shared ownership above that threshold. Permission ends if the manufacturer or distributor buys control of a franchisor or franchisor-controlled entity, or transfers its own controlling interest to one.

Warranty repair rules protect franchised dealers

Beginning August 1, 2025, manufacturers and related suppliers generally cannot operate warranty repair centers outside franchised dealerships. They also cannot authorize dealer-operated satellite centers within another same-make or same-line dealer's territory; recreational product manufacturers are exempt. Warranty repairs, including emergency repairs, can be authorized only for dealers, approved fleet owners, or emergency services companies and related companies. Fleet owners include governments and businesses owning or leasing vehicles for their use, or renting, maintaining, or leasing vehicles for others. Manufacturers with current or past Louisiana franchised dealers must notify the dealer responsible for the area when authorizing fleet warranty repairs.
