Gift-card fraud brings penalties and repayment

Beginning August 1, 2025, Louisiana's access-device fraud law covers gift cards and related account information. Gift cards include prepaid cards, codes, or devices redeemable for goods or services. Knowingly possessing 15 or more counterfeit or misappropriated access devices with intent to defraud is a crime. Gift-card value means the maximum face value while held for sale or the funds deposited at activation and purchase. For theft or misappropriation, maximum prison terms and fines depend on the total value: $25,000 or more, 20 years at hard labor and $50,000; $5,000 to under $25,000, 10 years and $10,000; $1,000 to under $5,000, five years and $3,000; under $1,000, six months and $500. These penalties allow imprisonment, a fine, or both. A third or later conviction carries up to two years in prison, a $2,000 fine, or both. Separate acts are added together to determine the penalty tier, even when they involve different victims. The law defines transfer as selling, giving, providing, or transmitting. Courts must order restitution under Louisiana's criminal procedure rules when sentencing someone under this fraud law. The law removes explicit examples covering attorney fees and costs to fix credit history or resulting debts. The provided text does not establish whether those costs remain recoverable under the referenced rules.
