Tighter lawsuit rules for sentenced Louisiana prisoners

Beginning August 1, 2025, the law applies only to future actions involving false imprisonment of people convicted and sentenced to prison. False imprisonment includes unlawful detention by Louisiana corrections officials, including being held past the required release date. Damages lawsuits follow Louisiana’s Prison Litigation Reform Act. Sentence, release-date, good-time-date, and parole-date calculation challenges must first go through the required administrative and court review process. This includes review in the Nineteenth Judicial District Court in East Baton Rouge Parish. Before suing a sheriff, the Louisiana Department of Public Safety and Corrections, or their officers or employees, the person must obtain a favorable outcome. That review must resolve the challenge on its merits, and all appeals must be finished. A damages suit filed during review is dismissed without prejudice, meaning it can be filed again. A suit filed after missing deadlines to start or pursue review is dismissed with prejudice, meaning it cannot be filed again.
