Beginning August 1, 2025, Louisiana municipalities can record property liens for unpaid water or sewage service charges or fees. This applies to properties with more than four dwelling units occupied by people other than the owner. A master meter service agreement must measure usage for the whole property or multiple units within a development. Owners get 30 days after written demand to pay before a municipality can file a lien. Notice can go to the owner's designated mailing or email address, or by another method reasonably calculated to give notice. Without a designated address, notice can also be hand-delivered to the property. Payments reduce the unpaid balance. A municipal official with knowledge of the debt must sign and verify a detailed statement filed in parish mortgage records. It must identify the property, recorded owner, unpaid amount, delinquency date, and demand date. The lien secures unpaid charges plus legal interest from their due dates. It starts upon filing and generally ranks ahead of later-recorded claims, subject to Louisiana's Private Works Act. Recording effects expire under existing law, which also allows renewal through re-recording. The law does not create personal liability for residents.
