4 provisions identified: 1 benefits, 3 costs, 0 mixed.
Beginning August 1, 2025, people unable to pay court costs because of poverty can bring or defend an estate case. They can proceed without paying costs upfront or as they come due. They also do not have to provide security to guarantee payment. This is not a permanent waiver of all costs.
Beginning August 1, 2025, the court-cost collection rule covers indigent parties, not just plaintiffs. It applies when a judgment orders that party to pay court costs. The officer owed the costs must record a sworn account in mortgage records. That record has the force of a judgment for the amount owed.
Beginning August 1, 2025, an estate must cover costs owed to public officers when a party receives permission to proceed without paying costs. The court must order payment from estate assets. This can leave less for heirs and other beneficiaries. This rule directs payment from the estate, not the party personally.
Beginning August 1, 2025, you must file a formal written opposition to object to probate without a contested trial. Probate is the court process for proving a will is valid. Speaking up at the hearing alone no longer counts as an objection. Once an objection is filed, the court can approve the will only after a trial where both sides can respond.
