Bourne takes senior housing land under restrictions

The law lets Barnstable County transfer two parcels at 0 County Road and 100 Dr. Julius Kelley Lane to the town of Bourne. The land serves an assisted living senior residence and stays under a conservation restriction (Document #978,790). The transfer also keeps a Cape Cod Commission approval from February 20, 2003 (Project TR #02051) and the existing ground lease in place. All recorded limits must be on file with the Barnstable town clerk. The parcel transfer and any assignment of the restriction must happen at the same time. The restriction does not merge into ownership; it stays a separate, binding limit. The act takes effect upon passage.
