Middleton land release and new protection

The law lets the Middleton Conservation Commission release about 38,197 square feet from a past conservation restriction to fix a violation. Before any release, the commission must accept a new conservation restriction on Lot 10A, about 9.33 acres, so there is no net loss under Article 97. Monastiero Consulting Services, LLC must pay all engineering, survey, appraisal, deed, and other costs for these land transfers. All other parts of the original conservation restriction stay in force. The release area is shown on a plan dated April 2, 2026 on file with the town clerk; Lot 10A is shown on a plan dated October 9, 1996 (Essex County Registry, Book 312, Plan 29).
