Maryland renters get limits on late fees

Beginning October 1, 2025, Maryland residential late fees cannot exceed 5% of unpaid rent for the period when payment was late. For weekly rent, the limits remain $3 per week and $12 total per month. The rule excludes home sellers who agree with buyers to stay in their owner-occupied home for up to 60 days after settlement. Lease terms exceeding these caps cannot be enforced. Tenants can recover actual damages, including reasonable attorney’s fees, when landlords include, offer, enforce, or signal plans to enforce prohibited terms.
