Maryland expands drug payment limit authority

Beginning October 1, 2025, Maryland’s drug affordability board must consult its Stakeholder Council about broader drug payment limits. It must create a process if it finds that process serves the state’s best interest. Initial limits target government purchases, government employee health plans, and Medicaid. Broader authority starts only after limits on two drugs have each been in effect for one year. The board must notify the Department of Legislative Services within five days after meeting that condition. Notice must arrive by September 30, 2030; broader authority starts upon receipt or expires if that deadline passes without notice. Broader limits exclude Medicare Part C and D reimbursements, federal 340B purchases, and federal programs Maryland cannot regulate. Before setting Medicaid limits, the board must check with Medicaid about federal rebate rules, other federal requirements, and added budget needs. Savings depend on the drug limits set; Medicaid eligibility and benefits do not change.

Maryland drops shortage safeguards for drug limits

Beginning October 1, 2025, Maryland’s drug affordability board can apply payment limits to drugs on the federal shortage list. The law removes the board’s duty to monitor supplies of drugs with payment limits. It also removes the duty to reconsider a limit when a drug runs short. Covered buyers can retain payment limits during shortages, but patients lose these required supply safeguards.
