Qualifying boat auctioneers avoid dealer status

Beginning July 1, 2025, Maryland excludes qualifying licensed auctioneers from boat dealer status under the State Boat Act. They must act for a seller, secured party, or owner without taking title to the boat. The auction must not be used to avoid the Act’s requirements. The dealer definition also includes lien holders selling boats under Maryland Commercial Law, Title 16, Subtitle 2, including lien and recovery companies.
