Bill Overview

Analyzed Economic Effects

4 provisions identified: 3 benefits, 1 costs, 0 mixed.

More abortion care help and privacy

Beginning July 1, 2025, Maryland provides grants for abortion care for people without enough resources. Help covers uninsured people, people without enough abortion coverage, and people unable to use insurance because insurer communications pose risks. Eligible groups must provide care through Maryland-licensed practitioners or manage funds for that care, remain in good standing, and maintain policies consistent with state abortion law. Grants can cover reasonable administrative costs, and the Department must set standards for their use. Neither the Department nor grantees may impose limits that conflict with state abortion law. The Department cannot collect identifying details about people seeking or receiving support, or disclose identifying details about covered organizations’ staff and care providers.

Insurer surpluses help fund abortion care

Beginning July 1, 2025, covered insurers must use abortion-coverage premiums for insured patients’ abortion care. A use rule directs 90% of qualifying excess account balances, measured 12 months after a plan year, toward care federal funds cannot cover. Separately, transfers to the grant fund are due by September 1, 2025, covering 90% of qualifying excess balances for plan years 2014–2023, including interest through December 31, 2024. Starting in 2026, annual transfers are due July 1, using a 15-month accounting window and interest through the previous December 31. Insurers must report receipts, payments, interest, and balances by March 1 each year, with supporting records; parties challenging a Commissioner’s order have hearing and appeal rights.

State funding supports abortion care grants

Beginning July 1, 2025, Maryland creates a dedicated abortion grant fund whose unused money carries forward. It receives insurer transfers, state funding, interest, and other accepted money; spending is limited to the program and state budget. The Governor must add $2 million by budget amendment by October 1, 2025. Starting in fiscal year 2027, the Governor’s annual budget must include funding at least equal to required insurer transfers. At least 90% of program appropriations must be awarded as grants.

Federal review can end abortion provisions

The law includes a federal-law trigger that ends Section 1, rather than an automatic expiration date. It applies if federal health officials notify Maryland’s Insurance Administration by June 30, 2031, that Section 1 violates the Affordable Care Act’s abortion-funding rules. If that notice arrives by the deadline, Section 1 stops operating and the Department of Legislative Services must be notified promptly.
