Maryland bans try-first rules for insulin

Beginning January 1, 2026, covered Maryland health plans cannot require patients to try another treatment before covering prescribed insulin. This protection covers FDA-approved insulin, insulin analogs, and drugs that work like insulin for type 1, type 2, or gestational diabetes. It applies regardless of how long the drug acts, when it is mixed, or whether it is injected or inhaled. Covered insurers, nonprofit health plans, and HMOs must follow the rule, including when they use pharmacy benefit managers. The rule applies to policies, contracts, and health benefit plans issued, delivered, or renewed in Maryland on or after that date.
