Genetic privacy protections for Maryland insurance buyers

Beginning October 1, 2025, these protections cover Maryland life and disability insurance, but not long-term care insurance. Insurers cannot base prices, coverage, renewals, or other terms on medical information, including genetic results, unrelated to insurance risk costs. They can show a cost link through sound insurance risk calculations or actual or reasonably expected experience. Insurers must get your signed, written consent before accessing sensitive medical information, including genetic data. They cannot require existing or new genetic testing or full genome sequencing for eligibility or coverage. They can still review application medical records and consider diagnoses, including those based on genetic tests. Insurers, applicants, and policyholders cannot waive or change these protections to avoid them. The Maryland Insurance Commissioner can issue enforcement orders for violations.
