Bill Overview

Analyzed Economic Effects

4 provisions identified: 2 benefits, 0 costs, 2 mixed.

New pension coverage for Maryland health workers

Beginning July 1, 2025, specified Maryland health workers at listed facilities enter the Correctional Officers’ Retirement System. Added jobs include CAMH Associate Supervisor–CI and Developmental Disability Associate Assistant Manager–CI, Manager–CI, and Supervisor–CI. Direct Care Trainee–CI and Licensed Practical Nurse III Advance–CI coverage applies to service on or after July 1, 2024. Membership is a condition of employment for specified jobs. Members in the newly listed July 2025 positions qualify for normal retirement based on their correctional-system service with 20 combined years of eligibility service.

Higher disability calculation for transferred state workers

Beginning July 1, 2025, qualifying transferred workers receive the higher of two ordinary disability benefit calculations. Their Employees’ Retirement System or Employees’ Pension System service must have transferred to the correctional system under this law. They must also be granted an ordinary disability benefit under state pension law. The retirement Board must compare the calculations required by sections 29-106 and 29-108 and pay the greater amount.

Some state workers keep sick-leave pension credit

Beginning July 1, 2025, qualifying correctional-system members can count earlier unused sick leave toward a vested Employees’ Pension or Retirement System benefit. A membership change must have forced their move from that former system, and its service credit must remain there. They must also have correctional-system service earned on or after July 1, 2016, that provides no benefit. The sick leave must have accrued before they joined the correctional system. Newly covered workers must serve in a listed July 2025 position on or after July 1, 2025.

State workers face pension transfer deadlines

These transfer rules cover employees working in affected positions on July 1, 2025. Employees with Employees’ Pension System credit earned before July 1, 2008, have service transferred to the correctional system on June 30, 2026. They can opt out by submitting the State Retirement Agency form to the Board by June 1, 2026. For employees applying to retire before June 30, 2026, transfer happens before retirement unless they opt out; this temporary rule expires June 30, 2026. Beginning July 1, 2025, affected employees without pre-July 2008 pension credit have their pension service transferred and combined with correctional-system service.
