Montgomery County development fee relief has limits

Beginning July 1, 2025, Montgomery County must grant full or partial exemptions from Washington Suburban Sanitary Commission system development charges. Covered uses include qualifying revitalization projects, child or after-school care, and programs and services for people with developmental disabilities. Youth-group property qualifies when primarily used for youth recreation and education by a tax-exempt nonprofit whose primary mission serves those purposes. That exemption is limited to $80,000. Qualifying retirement-community housing, other elderly housing, manufacturing, and biotechnology research and development properties also receive exemptions, using county-council definitions. County councils cannot require applicants to own the property. The county must approve eligible applications first come, first served, until the annual limit—including unused amounts from a prior fiscal year—is reached; the provided provisions do not state that limit’s amount.
