No advance approval for pediatric hospital transfers

Beginning January 1, 2026, Maryland’s Medicaid and Children’s Health programs cannot require advance approval for special pediatric hospital transfers. Covered private insurers, nonprofit health service plans, and health maintenance organizations face the same ban. For these private plans, the rule applies when coverage is issued, delivered, or renewed in Maryland on or after that date. Qualifying hospitals must be in Maryland and provide specified nonacute medical care, rehabilitation, therapy, or palliative care. They serve people under 22, plus people age 22 to under 23 with both physical and behavioral health conditions.
