Owners face stricter lead testing rules

Beginning October 1, 2025, Maryland requires accredited people to perform required lead-dust tests and inspections. Owners cannot hire related parties for this work. Testers must send verified results to the Department of the Environment, the owner, and any tenant. A report certifying compliance proves the owner meets the lead-risk standard while the certification remains effective. Exceptions apply for proven fraud, testing without accredited personnel performing or supervising it, or failure to respond to required complaints. The law uses existing enforcement procedures and caps one specified violation penalty at $500 per day. Owners who employ an accredited supervisor and actually know the supervisor falsely verified required work face a civil penalty up to $30,000. The separate $50,000 penalty for falsifying reports was struck from the bill and is not enacted.
