Bill Overview

Analyzed Economic Effects

5 provisions identified: 1 benefits, 0 costs, 4 mixed.

Owner-occupied homes protected from forced taking

Beginning April 22, 2025, the West North Avenue Development Authority cannot take owner-occupied homes through eminent domain. This means the Authority cannot force owners who live in their homes to sell using that power. The Authority's authorization runs through September 30, 2029.

Resident seats and fewer redevelopment rules

Beginning April 22, 2025, two Authority board members must live in communities affected by the target area or buffer zone. Designated community-group leaders select them by majority vote: one represents neighborhoods east of North Fulton Avenue and one west. The Authority can act without another state unit's consent and is exempt from some state budget and purchasing rules. It must still follow public records, open meetings, ethics, and specified finance rules, including Title 14, Subtitle 3. Its authorization runs through September 30, 2029.

Redevelopment fund with a self-support deadline

Beginning April 22, 2025, the law establishes a state-held Authority fund whose unused money carries into later years. It accepts state appropriations, interest, and other money; its interest stays outside the General Fund sweep for fiscal years 2024–2028. Spending must follow the state budget and cover only Authority administration and authorized work; no funding amount is set. The Authority must support itself beginning in fiscal year 2028, which starts July 1, 2027. Its authorization runs through September 30, 2029.

Longer redevelopment authority for West North Avenue

Effective April 22, 2025, the law extends the West North Avenue Development Authority's authorization from September 30, 2026, to September 30, 2029. Its target covers Baltimore's West North Avenue blocks 600–3200, with a buffer within 250 yards. The Authority can give individuals grants, develop and transfer property, and create special district benefits for target-area businesses. It must prepare a 20-year plan covering economic development, housing, transportation, neighborhoods, and green space. It generally cannot own and run projects unless its board finds private development interest and capacity lacking, or a government representative requests it in writing.

Tax breaks for Authority redevelopment projects

Beginning April 22, 2025, the West North Avenue Development Authority is exempt from state and local taxes and assessments on its projects. The exemption also covers project operations, maintenance, and revenue, plus state and local transfer and recording taxes. Property sold or leased to a private entity becomes subject to Baltimore City and local property taxes on that date. The Authority's authorization runs through September 30, 2029.
