Stronger enforcement against unlawful cannabis sales

Beginning July 1, 2025, Maryland field enforcement staff can issue citations or charging papers for delta-8 or delta-10 violations involving under-21 sales or required online age screening. In unlicensed THC sales cases, displaying or offering THC for sale—including at a business—can serve as initial proof of a sale. The commission’s executive director can seize, destroy, or confiscate products displayed or offered to consumers at improperly licensed locations when they violate product or advertising rules. Nonlicensees who break those product or advertising rules can receive citations and, if convicted, face a misdemeanor fine up to $5,000. Cannabis licensees who break those rules face administrative discipline instead.

Tighter product rules for cannabis sellers

Beginning July 1, 2025, Maryland sellers and distributors cannot sell THC products that break state potency, packaging, or labeling rules. They also cannot sell or distribute products advertised as containing a THC amount that violates state law. This advertising rule covers packaging, labels, and electronic messages.
