Maryland’s Prescription Drug Affordability Board must consult its Stakeholder Council and decide whether statewide drug payment limits serve Maryland’s best interest. If yes, it must create the process and set limits for drugs it finds cause or will cause affordability problems. Where applicable, it must consider government savings data, other states’ experience, and expected savings from Medicare’s negotiated maximum prices. The process excludes Medicare Part C and Part D reimbursements, federal 340B drug purchases, and federal payments Maryland cannot regulate. The law sets no specific payment limit or guaranteed household savings.
Before setting a drug payment limit for Maryland Medicaid, the Board must consult the program. They must check for conflicts with Medicaid drug rebates, federal outpatient drug rules, and other federal requirements. They must also assess whether the limit requires more money for Medicaid’s budget. This review does not itself change Medicaid eligibility, drug coverage, or patient costs.
The Board cannot apply a new payment limit to drugs listed in current shortage by the FDA or found scarce in Maryland. It may reconsider an existing limit if the drug becomes scarce. Pharmacy dispensing fees cannot count toward a drug payment limit or be capped by it. The Board must weigh effects on providers of 340B drugs and costs to administer, deliver, and handle drugs. For drugs designated for rare diseases or conditions, it must also consider effects on patients with rare diseases.
