Beginning October 1, 2025, Anne Arundel County Council can pass an ordinance waiving or crediting development impact fees. These fees help pay for public facilities needed for new development. Eligible projects include moderately priced homes, accessory dwelling units, qualifying workforce housing, and development by nonprofits operating for at least 3 years. Relief can also cover land or construction received and accepted by the County or County Board of Education. It must serve the same needs as the fees and add capacity beyond what Article 17 already requires. This includes developer-built contract schools under agreements with the State Board of Education. The ordinance must set relief amounts, eligibility rules, and application steps. The law does not automatically lower fees or guarantee lower home prices.
