Correctional pensions expand for Maryland health workers

The law requires listed Maryland health workers at seven facilities to join the Correctional Officers’ Retirement System. Covered jobs include direct-care, nursing, security, and supervisory roles. Qualifying service starts July 1, 2024, or July 1, 2025, depending on the position. Newly covered workers who are vested and have 20 combined years in the correctional and state employee retirement systems qualify for a special allowance. That allowance uses their correctional system service to calculate payments.

Higher disability benefit protects transferred state workers

The law protects workers whose state employee retirement or pension service transfers into the correctional officers’ system. When they receive an ordinary disability benefit, the retirement board must calculate it under both applicable benefit formulas. The board must pay the higher result.

Pension service transfers for covered state workers

Workers in affected jobs on July 1, 2025, receive transfers of earlier state pension service into the correctional system. Workers with Employees’ Pension System service before July 1, 2008, receive their transfer on June 30, 2026. They can decline by filing the State Retirement Agency form by June 1, 2026; retirement applications before June 30 trigger transfer before retirement unless declined. Workers without pre-July 2008 pension service have their pension service automatically transferred and combined with correctional service. The law also extends unused-sick-leave pension rules to qualifying service in newly covered jobs starting July 1, 2025, including proportional credit across systems and adjustments for qualifying leave earned before joining.
