Bill Overview

Analyzed Economic Effects

5 provisions identified: 1 benefits, 2 costs, 2 mixed.

Vape seizures come with return rights

Beginning October 1, 2025, Maryland’s Alcohol, Tobacco, and Cannabis Commission Executive Director can seize illegally sold or offered vape devices without a warrant. At seizure, the Director must notify the person holding them and explain how to seek their return. Owners or others with an interest must file a claim within 30 days or lose their rights to the devices. The Director or designee must order their return unless satisfactory evidence shows the owner or claimant was breaking the relevant law when seized.

Manufacturers can supply licensed vape shops

Beginning October 1, 2025, a licensed vape device manufacturer can sell devices to a licensed vape shop vendor. The shop must hold its own vendor license.

Vape wholesalers face detailed record rules

Beginning October 1, 2025, vape wholesalers, including distributors and importers, must keep purchase invoices and post daily receipt records. Daily entries must list invoice number, receipt date, quantity, brand, manufacturer, and supplier. They must keep retailer names and addresses, sales invoices showing each retailer’s local jurisdiction, and out-of-state resale records. Monthly inventories must cover devices on-site or under their control, except transfers to retail stock documented by written memorandum. Inventories may use the month’s start, end, or another specific practicable day; records must be available for the Director’s examination and kept six years unless the Director sets a shorter period.

State drops seized vape handling safeguard

Beginning October 1, 2025, the law removes this section’s explicit handling safeguard for seized vape devices. That safeguard required transport, storage, and destruction to follow applicable local, state, and federal law. This section sets no replacement standard; the repeal does not itself cancel other applicable laws.

Vape seizure cost powers narrow

Beginning October 1, 2025, the seizure section no longer expressly authorizes recovery of investigation and case-preparation expenses, including attorney fees. It also drops express power to impose and collect transport, storage, and disposal costs for seized devices. Nonpayment of these costs or expenses is no longer a listed ground for license denial or revocation under this section. However, a separate retained rule still leaves people responsible for reimbursing transport, storage, and disposal costs.
