East Millinocket gets state land purchase option
The law lets Maine offer East Millinocket an option to buy all or part of about 3,384 acres, excluding timber rights. Sales must be at current market value, based on a broker’s opinion and a current comparison with similar properties. Buyers take the property as is, without representations or warranties, through a quitclaim deed without covenants or a release deed. The state commissioner can use eminent domain to permanently settle ownership challenges. The commissioner can also arrange easements or other property rights that add sale value and release interests that add no value to the remaining property. If the town does not sign an option within one year after the law takes effect, the commissioner can pursue sales, leases, or auctions through brokers, bids, or direct deals, and reject offers. Any option and the authority to convey the property end five years after the law takes effect. Sale or lease proceeds must reimburse state administrative expenses and go into the Bureau of General Services’ capital repair and improvement account for capital improvements.
