You must sell directly to consumers. Consignment and wholesale sales are not allowed. You may sell online, by mail, or use delivery apps only if buyers can directly interact with you before the sale (in person or a live two-way meeting). Online, mail, or third‑party deliveries must be to buyers in Michigan only.
Annual gross sales are capped at $50,000 per person at a domestic residence. If your products sell for $250 or more per unit, your cap is $75,000. These caps apply until October 1, 2026. The department can ask to see sales records. Starting October 1, 2026, the department may adjust the caps each year for inflation using a Detroit CPI three-year average; the factor must be at least 1.00.
Cottage food operations do not need a state food license or routine evaluations. You are not required to meet the federal food code for licensing. You must still follow rules against adulterated or unsafe food. Other state, federal, and local laws still apply, and the department can enforce safety rules.
You qualify as a cottage food operation only if you make or package food in the kitchen of your primary home in Michigan. You may sell low‑risk foods like jams, jellies, dried fruit, candy, cereal, granola, dry mixes, vinegar, dried herbs, and baked goods. You may not sell high‑risk items like most canned foods, canned low‑acid or acidified vegetables (including salsa), meat or poultry, milk products, bottled drinks, or home‑made ice, or foods regulated under 21 CFR parts 108, 113, or 114. You must store all cottage food products only at your primary home.
You must prepackage items before sale and include a label. Labels must show your business name and address, or your business name, phone, and MSU registration number if registered. Labels must list the product name, ingredients by weight, net weight or volume, and allergen info. If you make a nutrition claim, you must follow federal rules. Labels must also say: "Made in a home kitchen that has not been inspected by the Michigan department of agriculture and rural development." This statement must be at least 11‑point font and easy to read.
You may register with the MSU Product Center if it runs a program. MSU may charge a one‑time fee up to $50 and will issue a registration number you can use on labels. MSU must share records with the department if asked. Your registration information is private and not subject to Michigan’s FOIA.
