When an insurer does not pay an assessment, interest, or penalties, DHHS notifies DIFS. After notice and a hearing, DIFS may suspend or revoke the insurer’s authority until all amounts are paid. DIFS must tell the legislative insurance committees within 10 days of any suspension.
The law charges insurance providers an annual per‑member‑month tax based on last year’s member months. Rates: Tier 1 Medicaid plan months use a DHHS‑set amount to meet a federal 1.00–1.02 test, with other Tier 1 months at $1.20; Tier 2 (non‑Medicaid) is $2.40; Tier 3 (Medicaid specialty plans) is $1.20. By May 15, agencies share counts; after June 1–15 providers get their bill; payments are due July 30, October 30, January 30, and April 30 (next business day if a holiday), and electronic payment can be required. The assessment is administered as a tax and does not count as a credit under Insurance Code section 476a. DHHS may keep using the CMS‑approved structure from December 20, 2024 and rely on that approval while the waiver stays in effect. In the first rollout year (2018–2019), the department sent prorated notices and two payments were due.
If CMS ends the December 20, 2024 waiver, DHHS must get approval for a revised, broad‑based structure. After approval, one uniform per‑member‑month rate applies to all insurers. The rate is set each year so total revenue does not exceed the amount due from April 1, 2024 to March 31, 2025.
The department can make rules under the state Administrative Procedures Act to run the assessment. Each year, no later than 120 days after May 15, it reports total revenue collected and its administration and compliance costs for the prior fiscal year to the budget director and legislative committees.
