Tougher penalties for fire safety violations

The law makes it a misdemeanor to violate the state fire prevention law or its rules, or to keep a fire hazard. When an owner runs a firm or vehicle in violation and that creates a fire hazard or a likely hazardous‑material release, the owner must pay a $200 civil fine for each violation. The state deposits all civil fines under this law into Michigan’s general fund.

Temporary door locks allowed if up to code

A labeled fire door with a temporary locking device or system is not a violation when installed as the cited state construction code sections allow. Owners and operators who follow those code rules can use these temporary locks without breaking the fire law.

Board faces transparency law penalties

A board member who intentionally breaks section 3b(6) faces penalties under the Open Meetings Act. If the board arbitrarily and capriciously violates section 3b(9), the board can be penalized under the Freedom of Information Act. This strengthens public access and oversight.

Changes take effect only with companion bills

This amendatory act takes effect only if both Senate Bill 96 and Senate Bill 98 of the 103rd Legislature are also enacted into law. Until those two companion bills are enacted, these changes do not take effect.
