If you file late, you pay $25 per business day after the first 10, up to $1,000. If you knowingly file an incomplete or inaccurate report, you can be fined up to $2,000. Unpaid fees or fines older than 180 days are sent to the Department of Treasury for collection. Every four years, these late fees and fines are adjusted for inflation using the Consumer Price Index. Paid late fees go to the state’s General Fund.
Public officers must file each year by May 15. This does not apply if you were a public officer only on January 1. For the 2024 year, your report is due June 13, 2025. The department posts the current form at least 30 days before each deadline; for 2025, by May 31, 2025. You can file online or by email, and email filings for the 2023 reporting period count. If the Secretary of State flags an error or missed filing, you have 9 business days to fix it or file.
People can file a signed complaint with the Secretary of State. The office notifies the subject, investigates, and may hold formal hearings. Cases about the Secretary of State or the Secretary’s spouse go to the Attorney General. Each report or its contents is posted online within 5 business days. If a report is late or wrong, the office notifies the filer within 9 business days after the deadline and posts whether there may be a violation within 45 business days after a rebuttal or complaint. Records and violation files are kept for 15 years. There is no private right to sue; this process is the way to enforce the law.
This law sets one standard form for state public officers like the governor, legislators, and other top officials. You must list each job that paid $1,000 or more, and your spouse’s employers at $1,000 or more. You must list unearned income sources over $200, real estate and other assets or securities worth $1,000 or more, and debts over $10,000. You also disclose gifts, travel, or charity payments reported by lobbyists, and any state contract or vendor interests. You do not list dollar amounts for these items; if you have a blind trust, say it exists but do not list its assets. Asset and securities thresholds rise for inflation every four years and are rounded up to the next $1,000.
If you are not reelected or not seeking reelection and sign a job that starts within one year, you must disclose it in writing within 10 days. List the date, the parties, and the general terms. The Secretary of State posts these disclosures online.
