You cannot perform mammography unless the machine is registered and the facility and operators meet state rules. The department adopts federal mammography standards and sets minimum training for staff. It can inspect machines and do follow-up checks as needed. Using a machine in violation can bring fines up to $500 per week. If the problem continues two weeks after a fine, the department posts a warning on the machine and at the entrance.
Owners of x-ray and mammography machines pay set annual fees. You pay $108.45 for the first dental or vet tube, $60.17 for each extra, and $180.83 for each other tube. Mammography inspections cost $241.26 per machine, and $241.26 again for any follow-up. The listed fees are adjusted each year by the Detroit CPI, capped at 5%. The department cannot waive these fees except where the law allows, and fees are nonrefundable. There is no fee to amend a registration. If a source is not inspected for 5 straight years, you owe no fees for that source until the first renewal after an inspection.
The law updates how Michigan licenses and oversees radioactive materials and other radiation sources. The department sets license, registration, safety, and record rules, and can set fee schedules. It avoids dual licensing when practical and may recognize other state or federal licenses, but can still require registration. A federal license held on the agreement’s effective date counts as a state license, but it ends on the federal expiration date or 90 days after a termination notice, whichever is earlier. Rules cannot limit intentional patient exposure for lawful therapy or licensed research. All fees go to the state’s general fund, and two older code sections are repealed.
