Cap on brewpub beer production each year

A brewpub may make up to 18,000 barrels of beer per calendar year. The cap applies to brewpub licenses tied to a class C, tavern, class A hotel, or class B hotel license. The brewpub may sell beer made on site for on‑site or off‑site use as allowed by law.

Limits on winemakers that make brandy

If a wine maker or small wine maker is licensed to make brandy, it may not make other spirits. The Liquor Control Commission may allow a brandy manufacturer to sell its brandy at retail under section 537.

Tasting rooms face fewer retail rules

If your license has a tasting room approved by the Commission, you are not treated as a retail licensee for most rules. Sections 701, 801, 803, 815, 905, and 906 still apply. This narrows which retail rules cover tasting rooms.

Bottling defined; growler fills excluded

The law defines bottling as filling and sealing a container with owned or leased equipment for sale. This can include kegs. Filling a growler for retail sale is not bottling.

New brand and wholesaler rules for alcohol

The law defines what counts as a brand and a brand extension for beer, wine, and mixed drinks. A supplier’s company name is a brand only if it is shown prominently; if it only identifies the maker, it is not a brand. A brand extension uses the same or a clear part of an older brand sold in Michigan. This applies even if the package, formula, container, alcohol type, or maker changes. Rights that exist on the act’s effective date stay in place, and the extension rules apply to new extensions after that date. If a supplier registers a product with brands from different suppliers, it must appoint the wholesaler(s) that hold rights to the underlying brand(s).
