The law creates a Local Government Reimbursement Fund in the state treasury. The state treasurer deposits certain use‑tax receipts and other money into it, invests the money, and credits earnings back to the fund. The Department of Treasury pays municipalities each year for property tax revenue they lost in the prior year from the small business property tax exemption. Payments are due on or before May 31 each year, starting in 2024, and only happen if the Legislature appropriates the money. If the fund does not have enough, the state prorates payments across eligible municipalities. Any money left in the fund at fiscal year end moves to the state’s General Fund and does not carry over, and Treasury oversees audits of the fund.
