The state runs a free public website listing every enacted earmark. It shows who requested it, who gets the money, the purpose, and status. Each chamber posts requests online within 5 business days. Bills with earmarks must have item details posted at least 45 days before final passage. Agencies also post and keep each item’s status up to date. Each item is presented at an appropriations hearing before the bill passes.
Starting January 1, 2026, for‑profit companies cannot get earmark money. A nonprofit can qualify only if it has operated in Michigan for three years, had a Michigan office for the past year, and has a board of directors.
Beginning January 1, 2026, agencies may spend earmark funds only under a signed agreement. The agreement must allow repayment for misuse, let the agency stop payments, and ban paying tax liens. Agencies must verify costs and eligibility before paying and follow the agreement’s payment schedule. They monitor use for the life of the project, up to seven years. The Auditor General reviews these items in annual audits. Agencies must tell recipients payment status and notify legislative leaders within 30 days after corrective action.
This section applies beginning January 1, 2026. It does not cover items requested or included before that date. An earmark is a set amount to a named entity, local unit, or project. It excludes emergency response, required program payments, and formula or competitive awards. It also defines leadership roles and uses the state’s nonprofit definition.
Starting January 1, 2026, lawmakers file requests on the official form. A first‑year request covers both years of a two‑year session. A second‑year request applies only to that year. Lawmakers not in leadership cannot request items outside their district or counties that touch it.
