Sell conserved farmland without fees

You can sell land under a development rights agreement or conservation easement without penalty if the buyer keeps it in compliance. You must tell the government that oversees the development rights about the ownership change. The state land use agency cannot charge a fee to process that ownership change.

Exit easement after death or disability

Enrolled land can be removed from the program when the owner or an individual essential to the farm dies or is totally and permanently disabled. The request must be filed within 3 years. For disability, only the owner may request; for death, the new owner by survivorship or inheritance may request. A statutory lien applies to any land that is relinquished. An essential individual includes a co-owner, partner, shareholder, farm manager, or family member who helps run the farm. A person counts as essential if they pay at least half of production costs and advise the owner, or if they work 1,040 hours a year in production.

Remove small building areas from easement

You can ask to remove up to 2 acres around buildings that existed before the agreement; up to 5 acres if needed to include all buildings. With local and state approval, you may also remove up to 1 acre measured by a licensed surveyor. If the new parcel is smaller than local zoning allows, you must get a variance. Any land you remove is subject to a statutory lien.

Split enrolled farmland, first split free

You can divide land covered by a development rights agreement into smaller parcels, and all parcels stay under the same terms. Each new parcel must be at least 40 acres or meet the program’s minimum enrollment rules. The first division has no state agency fee; later divisions can be charged a reasonable fee up to the agency’s actual cost. After a division is recorded, the state agency notifies you, the local government and assessor, reviewing agencies, and the state treasury.

Effective with companion farmland bills

These changes take effect immediately. The law ties them to six companion bills (SB 685, 687, 688, 689, 690, and 699).
