Tax credit for conserved farmland

If your farmland is under a qualifying agricultural conservation easement, you can claim a Michigan state tax credit. The credit applies when the easement is acquired under this program. The law here does not state the credit amount or whether it is refundable.

Owners can donate or regain rights

You can donate your development rights or a conservation easement to the state. The state does not have to be added as a coholder on an existing easement. An easement can also be transferred back to the property owner if both the state and the local government that hold it agree to the transfer and its terms.

Limits on nonfarm uses under easements

If your land has an agricultural conservation easement, the state reviews the uses allowed. It can block uses that harm farm productivity, change land or buildings to nonfarm uses, or break federal, state, or local laws. These limits can reduce what you can do on the land.

Law takes effect after linked bills

This law only takes effect after five listed Senate bills (Nos. 688, 690, 686, 689, and 685) also become law. Once all five are enacted, this act takes effect immediately.

How farmland easement grants are paid

After the board picks awards, the Department of Natural Resources pays the grants to the local governments that won them. A local government only receives the money when the department approves the easement being bought. Local governments may buy easements with grant funds using installment purchase agreements to spread payments over time.

Who holds and enforces farm easements

An agricultural conservation easement can be held by the state and the local government together. The state can delegate enforcement to local governments. If the board approves, a local government can hold an easement by itself, but the easement must give the state a third‑party right to inspect with reasonable notice and to enforce terms without unreasonably interfering with the owner’s quiet use.
