Easier loans for key farm owners

If your parcel has existing structures and meets section 36111(2)(a), and you are an “individual essential to the operation of the farm” under section 36110(6), the State must let a later mortgage, lease, or interest take priority over its recorded agreement or easement. This makes it easier for eligible farm operators to get financing or leases even when the land is under a farmland agreement or easement.

Clear rules for farmland easements

Development rights agreements and easements must last at least 10 years. Any signed after June 5, 1996 cannot run longer than 90 years. The State or a local government cannot sell or give up an agreement or easement without the landowner’s agreement, as provided by law. Older recorded liens or leases keep priority. Any State or local lien under this part is junior to a mortgage that was recorded earlier.

Start date tied to companion bills

This law takes effect only if five companion bills also become law: SB 690, SB 686, SB 689, SB 687, and SB 685 of the 103rd Legislature. Once that condition is met, it takes immediate effect. The enrolled law notes an effective date of December 23, 2025.
