Up to $1.7 million a year can pay agency and board administrative costs. After that, with board approval and a legislative appropriation, the fund can give grants to local governments for farmland preservation. If more than $5 million still remains, the fund can buy farmland development rights or agricultural conservation easements, with board approval and an appropriation. These purchases provide direct payments to landowners who qualify under state farmland preservation rules.
The law creates the Agricultural Preservation Fund in the state treasury. The state treasurer can take federal money, state revenue, gifts, and bequests into the fund. The treasurer invests the fund, and all earnings stay in it. Any money left at year end does not lapse back to the general fund. The department audits the fund, and money can be spent only after a legislative appropriation. The act is tied to six companion Senate bills and takes immediate effect.
