Job and license protections with limits

Minnesota hiring and licensing authorities cannot disqualify applicants for directly related convictions when they prove sufficient rehabilitation and current fitness for the work. Authorities may consider release orders and a certified copy of the applicant’s most recent military discharge record, tied to the conviction. That record must show an honorable discharge or separation under honorable conditions. It stops qualifying as rehabilitation evidence after a later gross misdemeanor or felony conviction following the discharge or separation date. Corrections discharge orders and proof of completed probation or parole are removed from the listed documents. Authorities must still consider other relevant evidence applicants provide. This includes the crime’s seriousness, surrounding circumstances and social conditions, age at the offense, time passed, and rehabilitation evidence such as references. Denials based partly or entirely on a conviction must be in writing. The notice must explain the reasons, complaint and grievance process, earliest reapplication date, and that all competent rehabilitation evidence will be considered upon reapplication.
