New rights to sue online publishers

Beginning July 1, 2025, individuals can sue businesses that knowingly and intentionally publish or distribute specified illegal material online. Covered material includes obscene matter and material depicting, describing, or promoting child pornography or child sexual exploitation. Courts can award nominal damages, actual damages, and up to $500,000 for nonfinancial harm, plus court costs and reasonable attorney fees. Punitive damages are also available when the conduct meets the legal standards for those awards. Claims can be combined when they meet the standards for joint lawsuits or class actions.

Limits on lawsuits against internet providers

Beginning July 1, 2025, internet providers, their affiliates and subsidiaries, search engines, and cloud services have limited liability protection. Providing access, connections, transmission, downloads, or storage alone does not violate this law. This protection applies only when the provider did not participate in creating the covered content. The law also preserves exemptions for genuine news or public-interest broadcasting.
