New penalties for helpers withholding ballots

Beginning July 1, 2025, Mississippi makes intentional ballot withholding by certain voting helpers a misdemeanor. The rule applies only to people assisting voters under Section 23-15-907 and ballots mailed to those voters. Helpers must willfully fail to send the ballot, intending that it not be cast and counted. A conviction carries up to one year in county jail and a fine of up to $1,000. The law also keeps the existing ban on removing ballots from a voting place before polls close. That offense carries up to one year in county jail, a fine up to $1,000, or both.
