North Dakota defines farmed elk and owners

The law sets what counts as “farmed elk” under chapter 36-25. It covers elk-family mammals (Cervus elaphus), but not red deer or North American elk (Cervus canadensis). Animals must be kept in a manmade pen that prevents escape and be raised for fiber, meat, byproducts, breeding, shows, harvest, or any other purpose. The law also says an “owner” is anyone who owns or is responsible for raising these animals. If your elk fit this definition, your operation must follow chapter 36-25 animal health rules, which can mean inspections, records, and enforcement.
