Utilities can buy out-of-state certificates

The law lets utilities and other buyers meet the renewable and recycled energy goal by buying and retiring renewable energy certificates. Certificates can come from out-of-state facilities. They must represent credits from sources that qualify under state law.

Tighter limits on hydro credits

The law tightens which hydroelectric plants can earn renewable or recycled energy credits. Only plants in service on or after January 1, 2007 qualify. Plants that existed on August 1, 2007 can qualify only for new power from repowering or efficiency upgrades. Electricity counts toward the state goal only if it follows the Public Service Commission’s tracking and verification rules. The prior hydroelectric section is repealed, so eligibility follows these updated rules.
